These Terms and Conditions (“Terms”) govern your access to and use of the Omega Creative Solutions website, generators, digital tools, downloadable materials, password-protected content and related services.

By accessing the website, purchasing a product, using a generator, or using an access code or password provided by us, you agree to these Terms. Please read them before using the site.

1. Who We Are

This website and the generators, tools and digital resources available through it are operated by Shanae Hunter, trading as Omega Creative Solutions (“Omega Creative Solutions”, “we”, “us” or “our”).

Omega Creative Solutions provides creative digital tools, AI-assisted generators, prompt generators, business resources, design tools, planning tools and other digital products intended to help users create their own finished work.

2. What Our Generators Do

Each generator is a creative tool that helps you produce a document, image prompt, design brief, plan, concept, written resource or other work product based on the information and selections you provide.

Depending on the generator, the result may be created:

• directly from the options you select;
• through a prompt generated for you to use with another service;
• through an AI provider that you connect;
• from information or images that you upload; or
• through a combination of these methods.

Different generators may provide different types of output.

The generators are tools. They are not substitutes for professional judgement or professional services.

Nothing produced by Omega Creative Solutions or one of its generators should be treated as legal, medical, financial, accounting, tax, therapeutic, engineering, electrical, safety or other professional advice.

We do not individually review, approve or verify every result produced by a generator.

3. Your Responsibility for What You Create

You are responsible for reviewing anything produced using our generators before you use, publish, manufacture, distribute or sell it.

You agree to check:

• facts and factual claims;
• spelling and grammar;
• measurements and dimensions;
• names, dates and prices;
• instructions and safety information;
• copyright, trademark and licensing issues;
• commercial-use requirements;
• platform requirements;
• manufacturing specifications; and
• any laws or regulations relevant to your intended use.

Where a generator relates to a subject involving real-world risk, including food preparation or preservation, children's activities, health, finances, tools, machinery, electrical work, legal matters or safety, you must use your own judgement and consult appropriate qualified professionals or official guidance where necessary.

Prices, AI services, platform rules, laws, fees, technical requirements and other time-sensitive information can change. You are responsible for checking current information before relying on generated content.

4. AI Features and Your Own API Key

Some Omega Creative Solutions generators may work without an external AI service. Other features may allow you to connect an AI provider using your own API key.

Where the website is configured to store that API key locally in your browser, Omega Creative Solutions does not receive, view or control that key.

Your relationship with an external AI provider is separate from your relationship with Omega Creative Solutions. You are responsible for:

• choosing your AI provider;
• creating and maintaining your account with that provider;
• safeguarding your API key;
• paying any fees charged by that provider;
• understanding the provider's usage limits;
• complying with the provider's terms; and
• confirming that the provider permits your intended personal or commercial use.

AI-provider fees are not included in an Omega Creative Solutions purchase unless we expressly state otherwise.

Never knowingly share your personal API key with another person.

5. Your Rights to Use the Output

Yes — Omega Creative Solutions allows you to use the finished work you create with our generators for personal and commercial purposes, subject to these Terms and any applicable third-party rights.

For example, you may use generator output to help create:

• artwork;
• print-on-demand products;
• books and ebooks;
• worksheets;
• planners;
• social-media content;
• advertisements;
• marketing materials;
• craft projects;
• digital products;
• business materials;
• client projects;
• websites;
• product concepts;
• design briefs; and
• other finished creative products.

You may edit, customise, combine, publish, print, manufacture and sell your finished creations.

As between you and Omega Creative Solutions, we do not claim ownership of the new finished output you create using the generators.

However, this does not mean that every AI-generated element automatically qualifies for copyright protection. Your rights in a particular output may depend on applicable copyright law, the amount of human creative contribution involved, the AI provider used, third-party material included in the output and the laws of your jurisdiction.

You are responsible for determining whether you have sufficient rights to commercially exploit a particular finished product.

What Commercial Use Does Not Include

Permission to commercially use your finished output does not give you permission to resell, duplicate or redistribute the Omega Creative Solutions generator that helped you create it.

You are buying or receiving permission to use the tool, not ownership of the tool itself.

6. Omega Creative Solutions Intellectual Property

The Omega Creative Solutions website and its original materials remain the property of Omega Creative Solutions. This includes, where applicable:

• generator software;
• generator structures;
• generator interfaces;
• generator names;
• question systems;
• dropdown systems;
• option libraries;
• curated selections;
• prompt frameworks;
• master prompts;
• instruction systems;
• generator source files;
• website code;
• page layouts;
• design systems;
• branding;
• logos;
• icons;
• graphics;
• written instructions;
• databases;
• collections;
• downloadable generator files; and
• other original Omega Creative Solutions materials.

Purchasing access does not transfer ownership of these materials to you.

7. What You May Not Do

Unless you have our prior written permission, you may not:

• resell an Omega Creative Solutions generator;
• sublicense a generator;
• redistribute a generator;
• upload a generator to another website for others to use;
• rehost a generator;
• give away copies of a generator;
• copy or reproduce our generator files;
• extract and sell our option libraries;
• extract and sell our prompt libraries;
• copy our generator structure to create a competing generator business;
• remove Omega Creative Solutions branding or ownership notices from materials where they are intended to remain;
• sell our original prompts or generator instructions as standalone prompt packs;
• share paid download links with unauthorised users;
• publish private passwords or access codes;
• allow multiple unrelated people to use a single-user purchase unless the product specifically includes multi-user rights;
• attempt to bypass payment or access controls;
• scrape or automatically extract substantial portions of the site;
• use our branding in a way that suggests you own or operate Omega Creative Solutions;
• use our generators for unlawful, fraudulent, deceptive or defamatory purposes;
• deliberately create material that infringes another person's copyright, trademark, privacy, publicity or other rights; or
• claim that generated material has been professionally reviewed when it has not.

You may sell the finished things you create. You may not sell the Omega Creative Solutions system that created them.

8. Paid Access, Passwords and Complimentary Access

Omega Creative Solutions may offer:

• individual generators;
• generator bundles;
• collections;
• digital downloads;
• special-access packages;
• site-access packages; and
• other digital products.

What is included in a purchase will be stated on the relevant product page or checkout page.

Personal Access

Unless a product expressly states that it includes a team, agency, classroom or multi-user licence, access is provided to the purchaser for their own use.

Complimentary Password Access

Omega Creative Solutions may also provide certain individuals with a private password, access code, complimentary licence or other method of accessing paid content without making a purchase.

Complimentary access is authorised access and does not constitute payment avoidance.

A complimentary password or access code:

• may be used by the person to whom Omega Creative Solutions provided it;
• remains the property of Omega Creative Solutions;
• may not be posted publicly;
• may not be sold;
• may not be shared with unrelated third parties unless we specifically authorise sharing;
• may be changed or withdrawn if it is misused; and
• does not transfer ownership of the generators or website content.

If we discover that a private password has been published or distributed without permission, we may disable or replace it.

Receiving complimentary access does not give the recipient permission to redistribute the generators.

9. Purchases and Payment

Prices are shown on the website or checkout page at the time of purchase. Prices may differ between:

• individual generators;
• generator bundles;
• special collections;
• promotional offers; and
• other products.

We may change prices for future purchases at any time. Changing a price does not change the price of a purchase you have already completed.

Unless the checkout page specifically describes a product as a recurring subscription or membership, purchases are one-time purchases and are not automatically recurring charges.

If Omega Creative Solutions offers subscriptions or recurring memberships in the future, the price, billing frequency, renewal terms and cancellation method will be disclosed before the customer agrees to recurring billing.

Payment may be processed by a third-party payment provider. We do not control the payment provider's separate terms, privacy practices or processing systems.

Any applicable taxes or additional charges will be disclosed or calculated as required.

10. Digital Products and Refunds

Omega Creative Solutions primarily provides digital products and digital access.

Because digital products can normally be accessed, downloaded or used immediately after delivery, digital purchases are generally final once access has been successfully provided, except where a refund is required by applicable law.

We may also consider a refund or correction where:

• you were charged more than once for the same transaction;
• you paid but never received the product or access;
• a technical problem on our side prevents you from accessing what you purchased and we cannot reasonably correct it; or
• the product delivered is materially different from what was described at the time of purchase.

Please include the name or email used for the purchase and enough information for us to identify the transaction.

Where possible, refund or access requests should be made within 7 days of purchase.

Nothing in this refund policy removes any consumer right that cannot legally be waived.

Refunds will not ordinarily be issued merely because:

• you changed your mind after accessing the digital product;
• you expected an AI provider to produce a particular result;
• you do not have an account or API key required by an external AI provider where that requirement was disclosed;
• an external AI provider changes its service;
• you no longer need the generator;
• you did not read the product description; or
• you purchased a generator and later decided not to use it.

11. No Guarantee of AI Results

Artificial intelligence can produce unpredictable, incorrect or inconsistent results.

Examples and sample images shown on the Omega Creative Solutions website demonstrate possible uses of our generators but do not guarantee that an external AI system will recreate the exact same result.

Results may vary depending on:

• the AI provider;
• AI model version;
• settings;
• uploaded images;
• prompt interpretation;
• moderation systems;
• provider policies; and
• changes made by third-party services.

We do not guarantee a particular image, text, business result, level of income, sales result or other outcome from using a generator.

12. Third-Party Platforms, Products and Names

Some generators may mention third-party platforms, AI companies, marketplaces, software, products or services in order to describe what a generator can help you create.

All third-party trademarks, service marks and company names belong to their respective owners.

Unless expressly stated otherwise, Omega Creative Solutions is not affiliated with, sponsored by, endorsed by or partnered with those third parties.

Examples may include services used for AI generation, ecommerce, print-on-demand, design, publishing or social media.

Your use of any third-party service remains subject to that third party's own terms, policies and fees.

13. Uploading Your Own Images or Content

Some generators may allow or instruct you to upload your own photograph, artwork, logo, text or other material.

You must only upload material that you have the right to use. By using material with a generator, you confirm that you own it or have sufficient permission to use it for your intended purpose.

You are responsible for obtaining any necessary permission from identifiable individuals shown in photographs or other submitted material.

Do not use another person's private photographs, artwork, logos, characters or other protected material without appropriate permission.

14. Availability and Changes to the Site

We aim to keep Omega Creative Solutions and its generators available and working properly, but uninterrupted availability is not guaranteed.

We may:

• improve generators;
• add options;
• remove options;
• correct errors;
• update prompts;
• redesign interfaces;
• replace tools;
• discontinue generators;
• perform maintenance;
• temporarily suspend features; or
• withdraw content.

We may make these changes without creating an obligation to maintain an older version indefinitely.

Where reasonable, changes will not intentionally remove a customer's existing purchased rights without a legitimate reason.

15. Suspension or Termination of Access

We may suspend, restrict or terminate access where we reasonably believe that a user has:

• shared private paid access without permission;
• published protected passwords;
• attempted to bypass payment controls;
• copied or redistributed generators;
• used the site unlawfully;
• seriously or repeatedly violated these Terms; or
• interfered with the security or operation of the site.

Where practical, we may contact the user before taking action, but we are not required to leave compromised passwords or security systems active.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website, generators and digital products are provided on an “as available” and “as is” basis.

We do not promise that:

• every generator will be error-free;
• every result will be accurate;
• every external AI provider will remain available;
• every prompt will produce identical results;
• every generated item can legally be copyrighted;
• every output will be appropriate for commercial use without review; or
• use of the generators will produce revenue, sales or business success.

You are responsible for deciding whether a generator and its output are suitable for your intended use.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Omega Creative Solutions and Shanae Hunter will not be liable for indirect, incidental, special or consequential losses arising from the use of, inability to use, or reliance on the website, generators or generated output.

This may include, where legally permitted:

• lost profits;
• lost sales;
• loss of business opportunity;
• wasted advertising spend;
• wasted manufacturing costs;
• loss resulting from inaccurate generated information;
• third-party platform actions;
• AI-provider charges;
• rejected listings;
• intellectual-property claims resulting from material selected or supplied by the user; or
• losses caused by relying on generated output without appropriate review.

Nothing in these Terms excludes or limits liability that applicable law does not allow us to exclude or limit.

18. Governing Law and Disputes

These Terms are governed by applicable United States federal law and the laws applicable in the U.S. state in which Omega Creative Solutions has its principal place of business, without regard to conflict-of-law principles.

Subject to any consumer rights that require otherwise, disputes relating to these Terms or Omega Creative Solutions will be handled by a court of competent jurisdiction serving the location of Omega Creative Solutions' principal place of business.

Nothing in this section removes any right or remedy that applicable consumer law requires to remain available.

19. Changes to These Terms

We may update these Terms when our generators, products, technology, payment methods or business practices change.

The “Last updated” date at the top of this page shows when these Terms were most recently revised.

Where a change materially affects an existing paid service, we will take reasonable steps to make the updated terms available.

Your continued use of the website after updated Terms take effect means that your future use of the website is subject to the updated Terms, to the extent permitted by law.

20. Severability

If any part of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

21. Entire Agreement

These Terms, together with any applicable Privacy Policy, Refund Policy, licence terms and specific terms displayed at checkout, form the agreement between you and Omega Creative Solutions regarding your use of the website and generators.
